2. Definitions

"Service" refers to the GolfBooker platform operated by Funect Oy, including the web application (app.golfbooker.fi), the mobile application (GolfBooker) and related systems and integrations. The Service may include functionalities provided by third parties (such as payment processing and golf federation integrations), which are also subject to those third parties' own terms and conditions.
"Customer" refers to a golf club, business or other organisation that has entered into a service agreement with Funect Oy for the use of the GolfBooker platform.
"User" refers to an individual who uses the Service, such as a player, club member, shareholder or guest. A User may use the Service either through a Customer's subscription or directly as a consumer.
"Consumer" refers to a User who uses the Service for purposes outside their trade, business or profession. Consumers are entitled to additional protections under Finnish consumer protection law.

The contractual relationship depends on the context of use: Customers enter into a service agreement directly with Funect Oy. Users who access the Service through a Customer's subscription are subject to both these terms and any terms set by the Customer. Users who use the Service directly as consumers enter into a contract with Funect Oy upon registration.

3. About the Service

GolfBooker is a tournament management and operations system operated by Funect Oy for golf clubs and businesses. The service includes:

Member and shareholder registry
Tee time reservations
Tournament management
Billing and payments
Mobile application
Statistics and reporting

4. Acceptance of Terms

By accessing and using the GolfBooker service, you accept and agree to be bound by these terms of service. If you do not agree with these terms, you must not use the service.

5. Who Can Use the Service

The service may be used by:

Golf clubs (business customers)
Club members and shareholders
Guest players (with club permission)

The user must be at least 13 years old. Users under 18 must have parental or guardian consent.

6. Registration and User Accounts

When creating an account, you must:

Provide accurate and truthful information
Keep your login credentials secure
Not share your account with others
Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account.

7. Use License and Restrictions

We grant you a limited license to use the service. You may not:

Modify, copy, or reverse engineer the service
Use automated systems (bots, scrapers) without permission
Remove copyright or proprietary notices
Use the service for illegal purposes
Interfere with or disrupt the service
Attempt to gain unauthorized access to systems

8. Payments and Billing

Business Customers

Pricing for Customers is based on the service agreement. All prices are in euros (EUR). Invoices are due within 14 days unless otherwise agreed. Late payment interest and dispute rights follow Finnish law. Fees paid under a service agreement are non-refundable except where mandatory law requires otherwise.

Consumers

Consumers have a 14-day right of withdrawal from the date of purchase in accordance with the Finnish Consumer Protection Act. If you request immediate access to the Service, the right of withdrawal does not apply to digital content or services already delivered. In practice, this means the withdrawal right does not cover features or content you have already used.

Refund requests from consumers are assessed in accordance with applicable consumer protection law. To request a refund, contact support@golfbooker.fi.

If you purchased a subscription or in-app purchase through the Apple App Store or Google Play, the app store's own refund process and policies may apply. In such cases, please contact the relevant app store directly.

9. Bookings and Payments (Players)

When you make a tee time reservation through GolfBooker, the contractual partner for the booking is the golf club or course, not Funect Oy. GolfBooker acts as a technical platform that facilitates the booking.

Cancellations and no-shows: cancellation policies, fees and no-show rules are determined by each golf club. Check the club's terms before booking. Cancellations are made through the GolfBooker app or by contacting the golf club directly, depending on the club's process.
Club-initiated cancellations: if a golf club cancels or modifies your tee time (for example due to course maintenance or weather), the club is responsible for notifying you and handling any applicable refund. GolfBooker will relay cancellation notifications through the app when possible.
Payments: payments are processed through third-party payment providers. You will receive a confirmation and receipt for each transaction.
Refunds and disputes: for refunds related to a booking, contact the golf club first, as the club is the contractual partner for the booking. If the issue is related to the GolfBooker platform or payment processing, contact support@golfbooker.fi and we will assist.

10. Data Ownership and Usage

Customer data belongs to the customer and can be exported at any time. GolfBooker may use anonymized data for service development. Personal data processing is described in our Privacy Policy.

User data is processed in accordance with our Privacy Policy. Users have the right to access, correct and delete their personal data as described in the Privacy Policy.

11. Third-Party Integrations

GolfBooker uses third-party services (eBirdie, payment providers, cloud hosting). We are not responsible for their operation or availability. Third-party services are subject to their own terms.

12. User Content and Conduct

You retain ownership of any content you create or upload to the Service (such as round data, scores and profile information). By using the Service, you grant Funect Oy a non-exclusive, royalty-free licence to display and process your content within the Service for the purpose of providing the Service to you and other users. Your content is shown to other users only in accordance with the visibility settings you have chosen in the Service.

When using the Service, you agree not to:

Share another person's personal data without their consent
Engage in harassment, threats or abusive behaviour
Submit false scores, handicap data or other fraudulent information
Use bots or automated tools to manipulate the Service

We reserve the right to remove content and restrict or suspend accounts that violate these rules. If you encounter inappropriate content or behaviour, you can report it to support@golfbooker.fi.

13. Service Availability

We strive to maintain the service available at all times, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to maintenance, updates, or technical issues. We will notify users of planned maintenance when possible.

No service level credits or compensation are provided for downtime, whether planned or unplanned, unless separately agreed in a written service agreement.

14. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the reasonable control of that party. Such circumstances include, but are not limited to: natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics or pandemics, strikes, power or telecommunications failures, cyberattacks and failures of third-party infrastructure or services.

The affected party shall notify the other party as soon as reasonably practicable and shall use reasonable efforts to mitigate the effects of the force majeure event. If a force majeure event continues for more than 90 days, either party may terminate the affected service agreement by written notice.

15. Disclaimer and Limitations of Liability

The service is provided "as is" without warranties of any kind, whether express or implied. GolfBooker's liability is limited to the extent permitted by law.

To the maximum extent permitted by applicable law, GolfBooker shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to data loss, loss of profit, loss of revenue, or business interruption, regardless of the cause of action. GolfBooker's total aggregate liability arising out of or related to the service shall not exceed the total fees paid by the customer in the 12 months preceding the event giving rise to the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for intentional misconduct, for gross negligence, or for any other liability that cannot be excluded or limited under applicable law.

Users are responsible for backing up their own data.

16. Intellectual Property

All intellectual property rights to the GolfBooker service, including but not limited to software, design, logos and trademarks, belong to Funect Oy. Unauthorized use, copying, or distribution of these materials is prohibited.

17. Termination

Business Customers

Customers may terminate according to their service contract. Upon termination, data is available for export for 30 days before permanent deletion.

Users (Players)

You can request account deletion at any time through the app or by contacting support@golfbooker.fi. A deletion request may require identity verification to protect your account. When your account is deleted, your personal data is removed in accordance with our Privacy Policy. You can also submit a data portability or deletion request through the data request form on our privacy page.

Termination by GolfBooker

GolfBooker may terminate or suspend access immediately for violations of these terms, fraudulent activity, or security risks.

18. Changes to Terms of Service

We reserve the right to update these Terms of Service at any time. We will notify users of significant changes via email or through the service. Continued use of the service after changes constitutes acceptance of the updated terms.

19. Governing Law and Disputes

These terms are governed by Finnish law. Disputes are resolved in the District Court of Helsinki. Consumers may also contact the Consumer Advisory Services (kuluttajaneuvonta.fi) for guidance before filing a complaint. Consumers may bring disputes to the Consumer Disputes Board (kuluttajariita.fi) or their local district court.
